The High Court has issued an order preventing the police from arresting or detaining two Members of Parliament (MPs) in connection with the investigation into the funding of the Gen Z protests.

MPs Under Investigation

Embakasi North MP James Gakuya and Embakasi Central MP Benjamin Mejja Donk were taken from Parliament buildings and questioned on July 31 regarding their involvement in the protest funding. Both MPs are known allies of Deputy President Rigathi Gachagua.

Other Individuals Questioned

In addition to Gakuya and Mejja Donk, other allies of Gachagua, including three aides, have also been questioned about their connection to the protests’ funding.

Legal Action and Court Orders

Gakuya and Mejja Donk have sought legal recourse to prevent their arrest related to the investigation. Justice Chacha Mwita has issued a conservatory order halting any arrest or detention of the MPs.

Next Steps

Further directions on the matter will be provided on September 17. In the interim, the court’s order restrains authorities from arresting, detaining, or otherwise interfering with the MPs’ liberty in relation to the allegations.

Justice Mwita’s order, dated August 5, 2024, specifies that no action should be taken against the MPs regarding the ongoing investigation.
