The Kenyan government has announced an impending nationwide crackdown on shisha and improperly labelled tobacco products, according to Health Principal Secretary Mary Muthoni. The move aims to curb the sale and consumption of these products, citing their significant health risks to both primary and secondary users.
Renewed Focus on Public Health
Despite a 2017 ban on the use, importation, manufacture, sale, promotion, and distribution of shisha, its consumption has persisted in various establishments across the country. This has raised alarms within the Ministry of Health, which is determined to address the issue.
The 2017 ban faced legal challenges, with the High Court ruling it unconstitutional. However, the government is doubling down on enforcement efforts through the establishment of a multi-agency task force. This team will include stakeholders from the health and security sectors, tasked with leading a nationwide campaign to eliminate the illicit trade of shisha.
Health Risks and Legal Penalties
Speaking at a Community Health Promoters (CHPs) sensitization workshop held at the Mahuti Catholic Church in Murang’a, PS Muthoni emphasized the dangers posed by shisha. The product’s impact extends beyond direct users to secondary consumers, making it a public health concern.
Under Section 163 of the Public Health Act (2017), individuals found violating regulations on shisha face penalties that include fines up to KSh 50,000, imprisonment for up to six months, or both. The Ministry’s upcoming actions are intended to ensure strict adherence to these regulations.
Previous Enforcement Actions
The crackdown follows a series of raids conducted in March 2024 by the National Authority for the Campaign Against Alcohol and Drug Abuse (NACADA), in collaboration with law enforcement agencies. One notable operation targeted a popular restaurant in Nairobi’s Kilimani area, leading to the arrest of four individuals, including the establishment’s manager, sellers, and a storekeeper. Authorities confiscated 46 shisha bongs, various flavored tobacco products, charcoal pipes, and inventory records during the raid.
Multi-Agency Strategy and Next Steps
According to PS Muthoni, the government is in the final stages of forming a coordinated response team. Although the specific timeline for the crackdown has not been disclosed, officials have warned that operations could begin at any moment.
This initiative underscores the Ministry’s commitment to safeguarding public health and addressing the challenges posed by the illicit tobacco trade. Businesses and individuals involved in shisha-related activities are urged to comply with regulations or face severe consequences.
