Kenyan Court of Appeal Halts GMO Imports Pending Legal Review

The Court of Appeal has halted the Kenyan government’s plans to import genetically modified (GMO) crops and food, granting temporary relief to opponents of the technology.

In a ruling favoring the Kenyan Peasants League, appellate judges imposed a hold on GMO imports as they review an appeal against the High Court’s earlier decision to lift the ban.

“We are persuaded that, in the circumstances of this case and given what is at stake, the precautionary principle militates in favor of granting conservatory orders during the pendency of the appeal,” the ruling stated.

Legal Challenge and Health Concerns

The appeal, filed by lawyer Kevin Oriri, argues that lifting the GMO ban failed to consider scientific research warning of potential risks to human health and the environment.

“The State plans to proceed with importing and distributing genetically modified foods, with GMO maize set for release into the Kenyan market almost immediately if preservatory orders are not granted,” Oriri stated.

Government’s Defense and Regulatory Assurance

Government representatives, however, countered the claims, asserting that Kenya has a robust legal and institutional framework to regulate GMO crops.

They emphasized that all GMO imports and cultivation would undergo rigorous scrutiny by regulatory bodies before approval.

Recognizing the urgency of the matter, the court has fast-tracked the appeal for a hearing in the second term of this year.
